These Terms of Service ("Terms") are a binding legal agreement between you and Archer Networks LLC, a Montana limited liability company doing business as Ivy Ham Herbalist and IvyHerbal ("Company," "we," "us," or "our"). They govern your access to and use of ivyherbal.com, its subdomains, and every product, service, publication, communication, and feature we offer through or in connection with it (collectively, the "Services").

Please read these Terms carefully. By accessing the Services, creating an account, placing an order, booking a consultation, enrolling in a course, subscribing to our newsletter, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years of age to use the Services, purchase products, book a consultation, or enroll in a course. By using the Services you represent that you are 18 or older and have the legal capacity to enter into this agreement. If you are between 13 and 17, you may read our educational content only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. We do not knowingly collect information from or sell to anyone under 13.

2. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page and changing the Last Updated date above. Material changes will take effect 14 days after posting. Your continued use of the Services after that date constitutes acceptance of the revised Terms. If you do not accept the changes, your only remedy is to stop using the Services.

3. The Services

The Company provides the following through the Services, each subject to the specific provisions below:

(a) Online Shop. Handmade herbal teas, salves, balms, tallow-based skincare, soap, upcycled textiles, and related physical goods, as well as digital products and gift cards.

(b) Educational Content. Articles, monographs, guides, recipes, and other written, visual, audio, or video material published on the site, in our newsletter, or on affiliated social channels.

(c) Online Courses. Self-paced or scheduled educational programs on herbalism, traditional food preparation, and related subjects.

(d) Consultations. One-on-one video or telephone sessions with Ivy Ham, a certified clinical herbalist, conducted for educational purposes.

(e) Newsletter. An email publication sent one to two times per month.

(f) Other Services. Any additional service we describe on the site, including web design services offered under the name Ivy Ham Designs, which may be subject to a separate written agreement.

4. No Medical Advice

Ivy Ham is not a physician, nurse, naturopathic doctor, registered dietitian, pharmacist, or licensed healthcare provider of any kind. The Company does not practice medicine and does not hold a medical license in Montana or any other jurisdiction. Clinical herbalism is not a licensed profession in the United States, and the certification held by Ivy Ham does not confer authority to diagnose, treat, cure, or prevent any disease or medical condition.

Everything offered through the Services, including articles, monographs, recipes, product descriptions, course materials, consultations, newsletter content, comments, and correspondence, is provided for general educational and informational purposes only. Nothing on the site or communicated to you by the Company constitutes medical advice, a diagnosis, a treatment recommendation, a prescription, or a substitute for the individualized judgment of a qualified healthcare provider who knows your history.

No practitioner-patient relationship is created by your use of the Services, by booking or attending a consultation, by purchasing a product or course, or by any correspondence with the Company.

You agree that you will consult a trusted, qualified healthcare provider before acting on any information obtained through the Services, before starting, stopping, or changing any medication, supplement, diet, or health practice, and before using any product if you are pregnant, nursing, trying to conceive, under 18, over 65, immunocompromised, taking prescription medication, or living with a diagnosed condition.

Never disregard professional medical advice or delay seeking it because of something you have read, heard, or purchased through the Services. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately. The Company does not provide emergency services.

Statements made about products, herbs, foods, or practices on the site have not been evaluated by the U.S. Food and Drug Administration or any other regulatory agency. Products sold through the Services are not intended to diagnose, treat, cure, or prevent any disease.

5. Consultations

(a) Educational Nature. Consultations are educational sessions in which Ivy Ham shares information drawn from traditional herbal practice, published literature, and personal experience. They are not medical appointments, clinical assessments, or therapy. You remain fully responsible for every decision you make during and after a session.

(b) No Prescribing or Diagnosis. The Company will not diagnose any condition, interpret laboratory results as a clinician would, prescribe or discontinue medication, or advise you to forgo conventional care.

(c) Your Disclosure Obligations. You agree to disclose all medications, supplements, allergies, pregnancies, and known health conditions before or at the start of a session so that potential interactions can be discussed. The Company relies on the accuracy of what you disclose and is not responsible for outcomes arising from incomplete or inaccurate information.

(d) Booking, Payment, and Cancellation. Consultations must be paid in full at the time of booking. You may reschedule or cancel without charge by giving at least 24 hours' notice by email to hello@ivyherbal.com. Cancellations with less than 24 hours' notice, and missed appointments, forfeit the full session fee. If the Company must cancel, you will be offered a new time or a full refund.

(e) Technology. Sessions are conducted over third-party video or telephone platforms. You are responsible for your own device, connection, and privacy during the session. The Company is not liable for interruptions, failures, or data exposure caused by third-party platforms or your equipment.

(f) Recording. Sessions may not be recorded by either party without the written consent of the other.

(g) Jurisdiction. You are responsible for determining whether receiving herbal education by video is permitted where you live. The Company offers consultations from Montana, United States, and makes no representation that the Services comply with the laws of any other jurisdiction.

6. Products

(a) Intended Use. Products are sold for personal, non-commercial use as described on their product pages. Read every label and product description in full before use and follow all directions. Do not use any product in a manner or quantity other than as directed.

(b) Topical Products. Balms, salves, soaps, and skincare are cosmetic products intended to cleanse, protect, moisturize, or improve the appearance of skin. They are not drugs and are not intended to treat any skin condition. Perform a patch test on a small area of skin and wait 24 hours before broader use. Discontinue use immediately if irritation occurs. Balms containing zinc oxide or other mineral ingredients are sold as mineral balms; the Company makes no sun protection factor (SPF) claim for any product and does not test products for SPF.

(c) Teas and Ingestible Products. Herbal teas and other ingestible items are sold as foods or beverages for general enjoyment. Herbs can interact with medications, affect pregnancy and lactation, and cause allergic reactions. Review every ingredient with your healthcare provider before consuming if you have any health concern.

(d) Allergens and Animal Ingredients. Products may contain or be produced in a home workshop alongside tree nuts, seeds, botanicals, bee products, essential oils, and animal-derived ingredients including beef tallow. You are responsible for reviewing ingredient lists for allergens and for ingredients you choose not to use.

(e) Handmade Variation. Products are made by hand in small batches. Color, scent, texture, weight, and appearance will vary between batches and from product photographs. Such variation is not a defect.

(f) Upcycled Textiles. Upcycled textile goods are made from previously used materials and may show wear, mending, or variation consistent with their history. These characteristics are disclosed and are not defects.

(g) Storage and Shelf Life. Products contain no synthetic preservatives unless stated. Store as directed, keep water out of jars and tins, and discard any product that changes in smell, color, or texture. The Company is not responsible for product deterioration resulting from improper storage.

(h) Children and Pets. Keep all products out of reach of children and animals unless a product is expressly labeled for that use. Products are formulated for adult human use unless stated otherwise.

7. Orders, Pricing, and Shipping

(a) Order Acceptance. Your order is an offer to purchase. We may accept or decline any order at our discretion, including for suspected fraud, pricing errors, or stock limitations. A confirmation email does not constitute acceptance; acceptance occurs when the order ships or, for digital goods, when access is delivered.

(b) Pricing Errors. We work to keep prices accurate, but errors occur. If an item is listed at an incorrect price, we may cancel the order and refund any payment, whether or not the order has been confirmed.

(c) Taxes and Duties. Prices exclude applicable taxes, duties, and customs fees. Sales tax is collected where required by law. For international orders you are responsible for all import duties, taxes, and brokerage fees, and for compliance with your country's import rules for botanical and animal-derived goods.

(d) Shipping and Risk of Loss. Shipping costs and estimated transit times are shown at checkout and are estimates only. Title and risk of loss pass to you when the carrier accepts the package. The Company is not liable for carrier delays, loss, theft after delivery, or damage in transit, though we will assist you in filing a carrier claim when insurance was purchased.

(e) Address Accuracy. You are responsible for providing a complete and correct shipping address. Orders returned or lost due to an incorrect address may be reshipped at your expense.

8. Returns and Refunds

(a) Consumable and Topical Goods. For hygiene and safety reasons, teas, skincare, soaps, balms, and all other consumable or topical products are final sale and may not be returned once shipped.

(b) Damaged or Incorrect Items. If a product arrives damaged, defective, or different from what you ordered, email hello@ivyherbal.com within 7 days of delivery with your order number and photographs. Approved claims will receive a replacement or refund at our discretion.

(c) Textiles and Non-Consumable Goods. Unused, unwashed non-consumable goods may be returned within 30 days of delivery for a refund of the item price. Return shipping is your responsibility unless the item was sent in error.

(d) Refund Method. Approved refunds are issued to the original payment method within 10 business days of approval or receipt back at our location.

9. Digital Products

Ebooks, handbooks, printables, templates, and other downloadable files ("Digital Products") are licensed, not sold. Upon payment you receive a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Digital Product for your own non-commercial purposes. You may not share, resell, sublicense, publicly post, or distribute Digital Products, remove any copyright notice, or use them to create products for sale. All Digital Product sales are final and non-refundable once the download link or file has been delivered. If a file is corrupted or fails to deliver, contact us within 7 days and we will provide a replacement file.

10. Courses

(a) License. Enrollment grants you a single-user, non-transferable license to access the course content for the access period stated on the course page, or for the lifetime of the course if no period is stated. Access may be revoked for violation of these Terms.

(b) No Sharing. Login credentials and course materials may not be shared, and course content may not be recorded, downloaded (unless expressly permitted), reproduced, or redistributed.

(c) Refunds. Course purchases are non-refundable once any course content has been accessed. If you have not accessed any content, you may request a refund within 7 days of purchase.

(d) Changes and Discontinuation. We may update, revise, or retire course content at any time. If a course is retired during a stated access period, you will be offered a comparable replacement or a prorated refund.

(e) No Professional Credential. Completion of any course does not confer a professional credential, certification, license, or authority to practice herbalism or any healthcare profession.

11. Gift Cards

Gift cards are redeemable only for purchases on ivyherbal.com and are not redeemable for cash except where required by law. Gift cards do not expire and carry no fees. Lost, stolen, or misused gift cards will not be replaced. Gift cards may not be used to purchase other gift cards.

12. Newsletter and Communications

By subscribing to the newsletter you consent to receive one to two emails per month containing articles, product updates, course announcements, and offers. You may unsubscribe at any time using the link in any email or by writing to hello@ivyherbal.com. Transactional emails related to your orders, accounts, or consultations will be sent regardless of newsletter preferences. By providing your email address you confirm it belongs to you.

13. Accounts

You may need to create an account to make purchases or access courses. You agree to provide accurate information, to keep it current, and to keep your password confidential. You are responsible for all activity under your account. Notify us immediately at hello@ivyherbal.com of any unauthorized use. We may suspend or delete accounts that violate these Terms.

14. Payments

Payments are processed by third-party providers, including Squarespace, Stripe, Shop Pay and PayPal. By providing payment information you authorize the applicable provider to charge the amount due. The Company does not store full payment card numbers. Your use of a payment provider is subject to that provider's terms. All prices are in U.S. dollars unless stated.

15. Affiliate Links, Referral Links, and Sponsored Content

Some links on the site are affiliate or referral links. If you purchase through such a link, the Company may receive a commission at no additional cost to you. The Company is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. Affiliate and referral relationships do not influence the editorial content of articles. The Company does not accept payment to publish articles, and any sponsored content will be clearly identified as such.

16. Intellectual Property

(a) Ownership. All content on the Services, including text, articles, monographs, recipes, formulations, photographs, illustrations, graphics, logos, product names, course materials, videos, audio, code, page layouts, and the compilation of all of these, is owned by the Company or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

(b) Limited License. You may view, download, and print one copy of content for your personal, non-commercial use, provided you keep all copyright and proprietary notices intact.

(c) Restrictions. You may not reproduce, distribute, publicly display, transmit, modify, translate, create derivative works from, sell, or otherwise exploit any content without prior written permission. This includes republishing articles or recipes in whole or in part, using product photographs, and using the Company's names, logos, or trade dress.

(d) Automated Access. You may not use bots, scrapers, crawlers, or any automated means to access, collect, or copy content from the Services, and you may not use any content to train, fine-tune, evaluate, or improve any machine learning or artificial intelligence system, whether commercial or non-commercial, without express written permission. Search engine indexing of publicly available pages in accordance with our robots.txt file is permitted.

(e) Trademarks. Ivy Ham Herbalist, IvyHerbal, Ivy Ham Designs, and associated logos are trademarks of Archer Networks LLC. Nothing in these Terms grants you any right to use them.

17. User Content and Feedback

If you submit reviews, comments, testimonials, photographs, questions, or other material ("User Content"), you grant the Company a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, publish, display, and distribute that User Content in any media for any purpose, including marketing, with or without attribution. You represent that you own or have rights to the User Content and that it does not infringe any third party's rights. We may remove any User Content at our discretion. Ideas, suggestions, and feedback you provide may be used by the Company without obligation to you.

Testimonials reflect individual experiences and are not a guarantee of results.

18. Copyright Complaints

If you believe content on the Services infringes your copyright, send a notice to hello@ivyherbal.com containing: a description of the copyrighted work; the URL of the allegedly infringing material; your name, address, telephone number, and email address; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature.

19. Prohibited Conduct

You agree not to: violate any law or regulation; infringe the rights of others; harass, threaten, or defame any person; upload malicious code; attempt to gain unauthorized access to any part of the Services or related systems; interfere with the operation of the Services; use the Services to send unsolicited commercial messages; impersonate any person or entity; misrepresent your identity, age, or health information; resell products purchased through the Services without written authorization; make health, medical, or therapeutic claims about our products on our behalf; or use the Services for any purpose that is fraudulent, unlawful, or harmful.

20. Third-Party Links and Services

The Services contain links to websites, products, platforms, and resources operated by third parties, including suppliers, referenced authors, research repositories, payment processors, and video platforms. These links are provided for convenience and do not constitute endorsement. The Company has no control over and accepts no responsibility for the content, accuracy, privacy practices, or availability of any third-party site or service. Your dealings with third parties are solely between you and them.

21. Accuracy of Information

We take care to source educational content from primary literature and named authorities and to update it periodically. Herbal knowledge, research findings, and regulatory positions change, and content may contain errors, omissions, or information that is no longer current. Content reflects the opinions and practice of the author and may differ from mainstream medical consensus. The Company does not warrant that any content is accurate, complete, or applicable to your circumstances, and undertakes no obligation to update it.

22. Disclaimer of Warranties

THE SERVICES, INCLUDING ALL CONTENT, PRODUCTS, COURSES, CONSULTATIONS, AND DIGITAL PRODUCTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PRODUCT, COURSE, OR CONSULTATION WILL PRODUCE ANY PARTICULAR HEALTH, COSMETIC, OR OTHER RESULT. NO ADVICE OR INFORMATION OBTAINED FROM THE COMPANY CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

23. Assumption of Risk

You acknowledge that herbs, botanical preparations, animal-derived products, and dietary or lifestyle changes carry inherent risks, including allergic reactions, drug interactions, skin sensitivity, and effects that vary by individual. You voluntarily assume all risk arising from your use of any product, content, course, or consultation, and you agree that you alone are responsible for evaluating the suitability of any information or product for your circumstances, in consultation with your own healthcare provider.

24. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS MEMBERS, MANAGERS, OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, ANY PRODUCT, ANY CONTENT, ANY COURSE, OR ANY CONSULTATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE COMPANY FOR THE SPECIFIC PRODUCT, COURSE, OR CONSULTATION GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you. In those jurisdictions liability is limited to the fullest extent permitted by law.

25. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its members, managers, owners, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your use of the Services; your violation of these Terms; your violation of any law or the rights of any third party; any health decision you make based on content, products, courses, or consultations; any User Content you submit; or any misuse, resale, or misrepresentation of products.

26. Dispute Resolution and Binding Arbitration

Please read this section carefully. It affects your legal rights.

(a) Informal Resolution First. Before filing any claim, you agree to contact us at hello@ivyherbal.com with a written description of the dispute and the relief you seek. The parties will attempt in good faith to resolve the dispute within 45 days of that notice.

(b) Binding Arbitration. If the dispute is not resolved informally, any claim arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Missoula County, Montana, or by video conference at the election of either party, by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

(c) Class Action Waiver. All claims must be brought in the party's individual capacity. You and the Company each waive the right to participate in any class, collective, consolidated, or representative action or arbitration.

(d) Small Claims Exception. Either party may bring an individual claim in small claims court in Missoula County, Montana, if the claim qualifies.

(e) Opt-Out. You may opt out of this arbitration agreement by emailing hello@ivyherbal.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

(f) Injunctive Relief. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized use of the Services.

(g) Time Limit. Any claim must be filed within one year after it arises, or it is permanently barred.

27. Governing Law and Venue

These Terms and any dispute arising from them or from the Services are governed by the laws of the State of Montana and the federal laws of the United States, without regard to conflict-of-law principles. Subject to Section 26, you agree to the exclusive jurisdiction of the state and federal courts located in Missoula County, Montana.

28. Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination your license to use content, courses, and Digital Products ends immediately. Sections 4, 9, 16, 17, 22 through 27, and this Section 28 survive termination.

29. Force Majeure

The Company is not liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, wildfire, severe weather, epidemics, labor disputes, supply and ingredient shortages, carrier failures, power or internet outages, government action, or platform outages affecting Squarespace or other providers.

30. Electronic Communications and Signatures

By using the Services you consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Your electronic acceptance of these Terms, including by clicking to purchase, book, or enroll, has the same legal effect as a handwritten signature.

31. General Provisions

(a) Entire Agreement. These Terms, the Privacy Policy, and any product-, course-, or service-specific terms posted on the Services constitute the entire agreement between you and the Company and supersede all prior agreements on the same subject.

(b) Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions remain in full force. If the class action waiver in Section 26(c) is found unenforceable as to a particular claim, that claim shall proceed in court rather than arbitration.

(d) Assignment. You may not assign or transfer these Terms or any rights under them. The Company may assign these Terms without restriction, including in connection with a sale of the business.

(e) No Third-Party Beneficiaries. These Terms create no rights in any person other than you and the Company.

(f) Headings. Section headings are for convenience and do not affect interpretation.

(g) Export and Local Law. You are responsible for compliance with all local laws that apply to your access to and use of the Services and any products you import.
