These Terms & Conditions ("Terms") are a binding agreement between you ("you," "your," or "User") and Archer Networks LLC ("Archer Networks," "we," "us," or "our") governing your access to and use of the Suntally mobile application and any related features, content, and services (collectively, the "App").

Please read these Terms carefully. By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the Privacy section below. If you do not agree, do not download, install, or use the App.

1. The App and What It Does

Suntally is an informational and educational tool that provides estimates of sun exposure and potential vitamin D production. It uses information you provide (such as your skin type, the portion of skin exposed, and your daily target) together with third-party weather, UV index, solar-position, and location data to generate approximate suggestions, timers, and readouts.

The App is a general wellness and informational aid only. It is not a medical device, and it is not intended to diagnose, treat, cure, prevent, or monitor any disease or health condition.

2. Estimates Only — No Accuracy Guarantee

All figures, times, UV values, vitamin D amounts, "time to your dose," burn-limit warnings, and other outputs produced by the App are estimates, not measurements. They are generated by mathematical models using inputs that you supply and data obtained from third-party sources. You understand and agree that:

• The accuracy of any output depends entirely on the accuracy and completeness of the information you enter and on third-party data that we do not control.

• UV index, cloud cover, temperature, and other weather and atmospheric data are forecasts or modeled values that may be inaccurate, incomplete, delayed, rounded, regionally averaged, or temporarily unavailable, and may differ from actual conditions at your specific location and from other sources.

• Individual factors — including but not limited to your actual skin response, melanin, medications, health conditions, altitude, reflective surfaces, shade, sunscreen, clothing, glass, and personal biology — vary widely and are not fully captured by any model.

• The App may produce results that are too high, too low, or otherwise wrong, and it may not warn you in time to prevent overexposure.

You should not rely on the App as your sole source of information. Always observe actual conditions yourself, use common sense, check current local weather and UV reports, watch your own skin and body, and adjust your behavior accordingly. The App is a convenience, not a substitute for your own judgment.

3. Not Medical Advice

The App and its content are provided for general informational and educational purposes only and do not constitute medical, health, dermatological, or professional advice. The App is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified physician or other licensed health provider with any questions you have regarding vitamin D, sun exposure, a medical condition, or before making any decisions related to your health. Never disregard or delay seeking professional medical advice because of something you read or saw in the App. If you think you may have a medical emergency, contact your doctor or emergency services immediately.

4. Assumption of Risk; Sun Safety

You understand that exposure to sunlight and ultraviolet (UV) radiation carries inherent and serious risks, including but not limited to sunburn, premature skin aging, eye damage, heat-related illness, dehydration, immune effects, and an increased risk of skin cancer (including melanoma), and that UV damage can be cumulative.

By using the App, you knowingly and voluntarily assume all risks associated with sun exposure and with any activity you undertake in connection with the App. You are solely responsible for your own safety, including monitoring your skin and body for signs of burning or distress, limiting your exposure, seeking shade, wearing protective clothing or eyewear, and applying sunscreen as appropriate. You agree not to treat any App suggestion as permission or a recommendation to remain in the sun.

5. Your Responsibilities

You agree to:

• Provide accurate information and understand that inaccurate inputs will produce inaccurate estimates.

• Use the App responsibly and in compliance with all applicable laws.

• Exercise your own independent judgment and not rely solely on the App.

• Supervise any minor in your care at all times during sun exposure and take extra precautions, as children's skin is especially vulnerable.

6. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the App on your own behalf. If you are under that age, you may use the App only with the involvement, consent, and supervision of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use.

7. Privacy and Your Data

We designed Suntally to keep your information with you.

• Local storage. The information you enter (such as settings, session logs, and notes) is stored locally on your device. We do not maintain user accounts and do not require you to register.

• We do not collect, sell, rent, share, or monetize your personal data. Archer Networks does not receive your session history, notes, or profile, and does not use your data for advertising, profiling, or any other purpose.

• Third-party weather and location data. To provide forecasts, the App transmits your approximate location (your GPS coordinates or the ZIP code you enter) to third-party weather, UV-index, and geolocation data providers solely to retrieve forecast data for your area. We do not control these providers, and their handling of any data they receive is governed by their own terms and privacy policies. We do not send them your name or other identifying details.

• Device permissions. The App may request location permission to estimate conditions for your area. You may decline or revoke this permission in your device settings; some features may not function without it.

• Your control. You can delete your locally stored data at any time by clearing the App's data or uninstalling the App.

[If you add analytics, crash reporting, advertising, or any other data collection, this section must be updated to disclose it accurately. A separate Privacy Policy is recommended for app-store compliance.]

8. Third-Party Data and Services

The App relies on data and services provided by third parties, including weather, UV, solar, and geolocation data sources. We do not endorse, guarantee, or assume any responsibility for the accuracy, completeness, timeliness, or availability of any third-party data or service, and we are not liable for any loss or damage arising from your use of or reliance on them. Third-party data may change, become unavailable, or be discontinued without notice.

9. Disclaimer of Warranties

THE APP AND ALL CONTENT AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Archer Networks disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, title, and non-infringement.

Without limiting the foregoing, we do not warrant that the App will be accurate, error-free, uninterrupted, secure, or available at any particular time or location, or that any estimate, calculation, or alert will be correct or will prevent injury. Any reliance you place on the App is strictly at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCHER NETWORKS LLC, AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, BODILY HARM, SUNBURN, SKIN DAMAGE, ILLNESS, HEALTH CONSEQUENCES, LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE APP, OR YOUR RELIANCE ON ANY INFORMATION, ESTIMATE, OR OUTPUT PROVIDED BY THE APP, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE APP, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Archer Networks LLC and its members, managers, officers, employees, contractors, licensors, and affiliates from and against any claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any injury, harm, or damage you or any third party suffers in connection with your use of the App or your sun-exposure activities.

12. Intellectual Property

The App, including its software, design, text, graphics, and other content (excluding third-party data), is owned by Archer Networks LLC or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the App except as permitted by law.

13. Changes to the App and These Terms

We may modify, suspend, or discontinue the App or any feature at any time without notice or liability. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, stop using the App.

14. Termination

These Terms remain in effect while you use the App. We may suspend or terminate your access to the App at any time for any reason. Upon termination, the provisions of these Terms that by their nature should survive — including Sections 2–4 and 8–16 — will survive.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction and venue of the state and federal courts located in Missoula County, Montana, and you consent to personal jurisdiction there. 16. Severability; Entire Agreement; Waiver

If any provision of these Terms is held to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy section, constitute the entire agreement between you and Archer Networks LLC regarding the App and supersede any prior agreements. Our failure to enforce any provision is not a waiver of our right to do so later.
